Chapter 1

SC POINT MANAGEMENT SERVICES SRL, Galati, str. Anul Revolutiei 1848 nr 31, Romania, share capital 200 lei, [email protected], is the owner of the trademark "BAND OF CREATORS" with registration number M2012/003237 (hereinafter referred to as "Band of Creators" or "we") and of the online store www.bandofcreators.com(hereinafter referred to as "site"). All orders placed by you in the online store are subject to the terms and conditions defined below, as published on this site at the time of order placement.

Chapter 2 Copyright & Use of Trademark

SC POINT MANAGEMENT SERVICES SRL is the owner of the website WWW.BANDOFCREATORS.COM and its content. This includes, but is not limited to, texts, images, design and format. The materials presented on WWW.BANDOFCREATORS.COM are protected by copyright.

You may not modify, copy, distribute, reproduce, publish, obtain licenses, commercially exploit, create derivatives from the displayed items, transfer or sell any part of the site content, program, products or services presented on this site.

WWW.BANDOFCREATORS.COM is a retail store. Products sold in this store are intended for consumption, and their resale is strictly prohibited (according to the Tax Code). You may not use this site or part of its content for any commercial purpose, nor to obtain any advertising-type income.

Chapter 3 Important Information

3.1. Products on www.bandofcreators.com are presented in the form of digital photographs describing the products offered for sale. Minor differences between photographs and the received product are not considered defects.

3.2. Some products presented on www.bandofcreators.com may not be available during certain periods. Prices may be subject to changes depending on the time of order placement. All prices are listed in RON and EUR and include VAT. Unless otherwise stated, products are delivered free of charge. Online card payments are made in RON or EUR. This is specified at checkout, when finalizing the order, on the secure website of the online payment processor Mobilpay www.mobilpay.ro. Prices in RON are valid for payments in RON and deliveries within Romania. Prices in EUR are valid for payments in EUR and deliveries to countries specified on the site, outside Romania.

We reserve the right not to offer the free delivery option for countries that are not listed in the list of countries with free delivery at checkout.

3.3. Band of Creators is entitled to make partial deliveries.

3.4. Discount coupons and gift vouchers have a validity of 6 months from the date of purchase and cannot be returned or refunded.

Chapter 4 Deliveries and Delivery Methods

4.1. International deliveries are made through several couriers. The transport risk is assumed by Band of Creators.

4.3. The delivery fee by courier in Romania is zero. Band of Creators does not deliver in Romania through Romanian Post. Delivery will be made through Fan Courier.

4.4 For delivery to other countries that are not specified in the country list at checkout (checkbox for "other countries"), an email will be sent to [email protected] to receive information about the cost and delivery time. The customer will bear the delivery cost.

4.5. The delivery time is mentioned in number of business days and is specified for each product on the site. The count begins the second business day after order confirmation (for cash on delivery orders or bank transfer) or the second business day after order placement for valid orders with card payment. At checkout, the maximum estimated time for the package to reach the customer is specified. The customer will accept the order if it arrives before the specified maximum deadline.

Chapter 5 Payments

Payment methods for orders placed on the Band of Creators website are: online card payment, cash on delivery, bank transfer payment, gift voucher payment or partial payment with discount vouchers. Card payments will be made in RON through Mobilpay Romania www.mobilpay.ro. Cash on delivery is valid only for Romania and will be made only in RON.

Chapter 6 Property Rights

The ownership right of each and all delivered products remains with Band of Creators until the price of the products enters Band of Creators' account.

Chapter 7 Contract

7.1. Upon placing an order in the Band of Creators online store and agreeing to the terms and conditions, these enter into force. The order is considered placed when you have entered all the information requested in the checkout system and have submitted the order.

7.2. Band of Creators reserves the right to refuse an order without providing explanations. Reasons for refusing an order may be based on the suspicion that the respective ordered products will be resold, on a history of orders coming from that user or from that area. In case of order refusal, the person who placed the order will be informed in writing and will be refunded if payment has already been made.

Chapter 8 Printed Version of the Contract

Band of Creators saves the information entered in the checkout system. If you want a printed copy of your order, please print the confirmation email received. It contains all necessary information.

Chapter 10 Warranties

10.1 All products sold on the Band of Creators online store are new products from authorized sources. Before delivery, all products are carefully examined before delivery so that you receive them in the best conditions. If you notice a non-conformity due to a manufacturing defect, we will replace the product free of charge.

10.2 All products sold in the Band of Creators online store have a 30 calendar days warranty. The warranty is valid only if the products have been used for their intended purpose, if they have no visible defects due to wear or improper use, and are accompanied by the invoice issued by Band of Creators SRL received with the product. In the absence of a warranty certificate, the invoice is considered a warranty document.

10.3 Legal warranty of conformity. All products benefit, by law, from the warranty of conformity which represents the legal period of 12 months during which the product is brought to conformity free of charge for the consumer. Within the conformity warranty period, the manufacturer repairs, replaces or refunds the value of the product. The time period established for repair remedy cannot exceed 14 calendar days from the date the buyer brought to the seller's attention the lack of conformity of the product.

Chapter 11 Return Instructions

11.1 Right to Return

Customers have the right to return the purchased product/products within 14 calendar days. The 14 calendar day period begins when the product/products are received. Customers will bear the cost and risk related to the transport of returned product/products.

11.2 Effects of a Return

In case of a return, the amount collected by Band of Creators related to the product/products must be returned by the customer. Band of Creators will not refund the transport cost if the customer chooses a transport option with cost. In the event that products have been damaged due to wear (using the product beyond a simple test), the product cannot be returned.

The return request must be made within a maximum of 14 calendar days from the date of receipt of the products by the customer.

Please note that we can only process returns from the country to which delivery was made. For example, if delivery was made to France, we accept the return of that product only from France.

In case of a return, we will make the payment to the account from which we collected the amount related to the returned product. If it is a cash on delivery return, the customer will indicate a bank account for payment. We do not cover currency exchange losses. Payments will be made in EUR or RON, depending on the currency in which the initial payment was made.

From the date all return conditions are met and the product has reached Band of Creators and has been verified, payment for the returned product/products will be made within a maximum of 14 calendar days.

Chapter 12: Privacy Policy

12.1 Personal Data Operator:

12.2 What Information Do We Collect and How?

12.2.1 Information you provide when registering as a User on bandofcreators.com. We will use this data to identify you as a User and to provide you with access to various products and services you benefit from as a User. If you wish to cancel your User account, you can do so by email to [email protected] or contact Customer Service at 0754 041 735.

12.2.2 Information necessary for delivering your orders. Depending on the necessary information, this may include first name, last name, address, phone number, email address, images or financial information (including card data, which is used exclusively by our payment processor, NETOPIA SRL). We will use your data strictly for the following purposes:

• to inform you via email/phone/sms about your order status
• for invoicing purposes and to provide you with invoices/receipts/fiscal receipts. We mention that the data necessary for invoicing (first name, last name, address) are transmitted to third parties, namely to the accounting services provider INTELLIGENT IT SRL.
• for delivering your order. Your data (first name, last name, address, phone number) are transmitted to the logistics services provider, Fan Courier Express SRL.

12.2.3. Information collected by the IT department. Each time you navigate bandofcreators.com, certain information may be stored, such as:

• Cookies. We use cookies and similar devices to facilitate your navigation on bandofcreators.com, to know how you interact with us and to display ads based on your browsing habits. We do not store sensitive personal information such as addresses, passwords, bank data in the cookies we use. 12.3.1 Keeping your data safe is very important to us. That's why we take a series of measures to protect it:

• we do not store information related to your bank data
• we regularly monitor IT servers to avoid possible fraud. However, transmission of information on the internet is not 100% secure. We cannot guarantee the security of your personal data that has been transmitted on our site, and the decision to transmit it belongs entirely to you.

12.3.2 We will process your data as long as you have an active account on bandofcreators.com, an order in progress, are subscribed to the newsletter or have an ongoing request with Customer Relations Service.

12.4.4 Under the conditions provided by legislation on personal data processing, as data subjects, you benefit from the following rights:

• right to information, namely the right to receive details regarding processing activities carried out by Band of Creators, according to those described in this document;
• right of access to data, namely the right to obtain confirmation from Band of Creators regarding personal data processing, as well as details regarding processing activities such as how data is processed, the purpose of processing, recipients or categories of data recipients, etc.;
• right to rectification, namely the right to obtain correction, without justified delays, by Band of Creators of inaccurate/unjustified personal data, as well as completion of incomplete data; The rectification/completion will be communicated to each recipient to whom the data has been transmitted, except when this proves impossible or involves disproportionate efforts.
• right to data deletion, without unjustified delays ("right to be forgotten"), if one of the following reasons applies:
  • they are no longer necessary for fulfilling the purposes for which they were collected or processed;
  • if consent is withdrawn and there is no other legal basis for processing;
  • if the data subject opposes processing and there are no legitimate reasons that prevail;
  • if personal data has been processed illegally;
  • if personal data must be deleted to comply with a legal obligation;
  • personal data was collected in connection with offering information society services according to Union law or internal law under which the operator falls.

It is possible that, following the request to delete data, Band of Creators may anonymize this data (thus depriving it of personal character) and continue under these conditions processing for statistical purposes;

• right to restrict processing to the extent that:
  • the person contests data accuracy, for a period that allows us to verify data correctness;
  • processing is illegal, and the data subject opposes deletion of personal data, requesting instead restriction of their use;
  • the operator no longer needs personal data for processing purposes, but the data subject requests them for establishing, exercising or defending a right in court; or
  • the data subject has opposed processing (other than direct marketing), for the time interval during which it is verified whether the operator's legitimate rights prevail over those of the data subject.
• right to data portability, namely (i) the right to receive personal data in a structured manner, commonly used and in an easy-to-read format, as well as (ii) the right for this data to be transmitted by Band of Creators to another data operator, to the extent that the conditions provided by law are met;
• right to object – regarding processing activities, it can be exercised by submitting a request according to those indicated below;
  • at any time, for reasons related to the particular situation in which the data subject is, that the data concerning them be processed based on Band of Creators' legitimate interest or public interest, except when Band of Creators can demonstrate that it has legitimate and imperative reasons justifying processing that prevail over the interests, rights and freedoms of data subjects or that the purpose is establishing, exercising or defending a right in court;
  • at any time, free of charge and without justification, that the data concerning them be processed for direct marketing purposes.
• right not to be subject to an automated individual decision, namely the right not to be the subject of a decision taken solely on the basis of automated processing activities, including profiling, that produces legal effects concerning the data subject or similarly affects them to a significant extent;
• right to address the National Authority for the Supervision of Personal Data Processing or competent courts, to the extent you consider necessary.

Chapter 13 Applicable Law

13.1 Romanian law applies.

13.2 If one or more articles are invalid, the validity of the other articles is not affected.
